Spokeo Strikes Again: Why Challenges to Standing Are Key

The Ninth Circuit affirmed in July the district courts decision granting summary judgment to State Farm to a putative Fair Credit Reporting Act (FCRA) class action in Dutta v. State Farm Mutual Automobile Insurance Company. In the case, plaintiff Bobby S. Dutta alleged State Farm violated section 1681b of the FCRA by failing to provide him with a copy of his consumer report, notice FCRA rights and an opportunity to challenge inaccuracies before being denied employment. The decision highlights the importance of continuing to challenge standing at all stages of a case.
