Oklahoma’s “Unity Bill,” which was signed in March and clarifies certain regulatory aspects of the state’s existing medical marijuana law, includes provisions that will be helpful to employers in the state. Although the medical marijuana law was approved in June 2018, it offered broad discretion to prescribing physicians and restricted employers from taking action against applicants or employees based on their status as a medical marijuana license holder or due to a positive drug test result. The Unity Bill offers guidance on the issuance of patient licenses and the creation of a medical marijuana use registry, while sharing specifics regarding adverse action taken as the result of positive drug test results.
