The New Jersey Cannabis Regulatory and Expungement Aid Modernization Act (Modernization Act), which was set to be voted on March 25 by New Jersey’s legislature, would legalize the recreational use of marijuana for adults over the age of 21, while addressing its taxation and sale, and prior convictions related to cannabis products. The Modernization Act would prohibit employers from refusing to hire or employ any person or discharge from employment any employee for reasons related to the use of cannabis, unless there is a “rational basis” for doing so. The bill does not address whether employers can continue to preclude employees from engaging in off-work marijuana use.
