North Dakota joined 28 states across the nation who have legalized some form of medical marijuana use when its Compassionate Care Act went into effect in December. The Act does now allow employees to possess marijuana in the workplace, nor does it include antidiscrimination provisions. Employers in the state are free to choose to comply with federal laws where North Dakota and federal law differ. Companies could continue to prohibit marijuana possession and its use for medical purpose in their drug-free policies. Those companies who choose to prohibit its use should consider updating their policies
