Marijuana in Your Florida Workplace

Following the approval of the Florida Medical Marijuana Legalization Initiative, it would be wise for Florida business owners to answer challenging questions about marijuana within the business. The state’s law provides a constitutional right to use medical marijuana for individuals with identified medical conditions, but Florida Statute 381.986 is vague about what a Florida-based employer must do in terms of accommodating a medical marijuana card holder in the workplace. The drug remains a Schedule I drug, so, for now, Florida employers should maintain their drug-free environment and continue testing for marijuana to prevent potential impacts from affecting the workplace.
