WILL WIDENED CLASS ACTIONS REGIME BOOST DATA LITIGATION IN THE NETHERLANDS?

The Dutch Senate has approved legislation introducing collective damages actions in the Netherlands that will broaden the regime even further. The legislation is expected to enter into force in July 2019 and will apply to events that took place on or after November 15, 2016. Key features of the legislation include an option to claim monetary damages in a collective action on an opt-out basis; appointing exclusive representative; and enhanced standing and admissibility.
