I-9 inspections are sweeping the nation and it’s important for businesses to be prepared should Immigration and Customs Enforcement (ICE) come knocking to serve a Notice of Inspection (NOI). With three days to prepare – unless ICE officials have a search warrant or subpoena, in which case immediately contact an attorney – employers can take a few steps to appropriately react. Start by separating I-9s from their personnel files; review all I-9s for complete compliance; fix any errors and complete missing forms; and re-verify any employees whose temporary work authorization expired.
