The Case of the Rehired Rapist: A Lesson in Background Checks

The case of The Scott Fetzer Co. v. Great Am. Ins. Co. reinforces the importance of background checks that are national in scope and the need for employers to consider the criminal charges that may turn up before hiring or re-hiring a person with past convictions. In this case, three employees filed a suit against the company, claiming it was negligent in hiring (and re-hiring) John Fields, who had a history of embezzlement, unlawful imprisonment, domestic abuse, and rape.
