Pre-Employment Testing for Marijuana?

Effective May 10, 2020, it will be unlawful for an employer and others to test for marijuana or THC as a condition of employment in New York City. There are only a handful of exceptions, which include those employed as police officers or peace officers, or in a position with a law enforcement or investigative function at the department of investigation; construction workers; operators of vehicles requiring a commercial driver’s license; those in any position requiring the supervision or care of children, medical patients or vulnerable persons; or those in any position with the potential to significantly impact the health or safety of employees or members of the public.
