Pre-Employment Screening and the New Marijuana Laws

With 39 states and the District of Columbia enacting some form of marijuana laws, some for medicinal purposes and others for recreational use, employers are left to consider how to properly implement pre-employment drug testing policies. Some parts of the country, such as Nevada and New York City, have banned pre-employment testing for marijuana, while others have legislation that protects those who use marijuana for medical reasons. Not all jobs are included under these laws, such as drivers, law enforcement officers and emergency EMTs, as well as some federal positions. These individuals can still be screened for marijuana use and be refused for employment based on results.
