Philly to Ban Use of Positive Marijuana Test for Employment Decisions

Philadelphia has officially banned employers from taking adverse action against job applicants who test positive for marijuana. The move closely follows the state of Nevada, which prohibits employers from taking adverse action against job applicants who test positive for marijuana, and New York City, where employers are barred from requiring applicants to submit to testing for marijuana. Exceptions exist in Philadelphia for those in safety-sensitive positions and motor vehicle drivers who are subjected to testing for marijuana under state and/or federal law, among others.
