A new survey shows U.S. corporate counsel face growing litigation risks, especially in data privacy, with 38% of organizations reporting increased exposure. Industry hotspots include technology, consumer markets, and retail. Forty percent of survey respondents experienced data privacy class actions, compared to 32 percent in 2024. The average litigation spend for companies with $1 billion or more in revenue in 2025 was $4.1 million, down from $4.3 million the previous year.
