NJ Privacy Law Litigation Continues in the Midst of Uncertainty

There is ongoing litigation under New Jersey’s “Daniel’s Law,” which protects the home addresses and phone numbers of judges, law enforcement officers, and other covered individuals. A company called Atlas Data Privacy has filed lawsuits against several data-broker and information companies, alleging they continued to publish protected information despite receiving removal requests. The cases seek statutory and punitive damages. Meanwhile, proposed legislation and pending court decisions may clarify the law’s scope and address concerns about the growing volume of lawsuits.
