New Privacy Law Could Apply to All Non-Profits – Ontario Government Launches Consultations

In August, the Ontario Government launched consultations on establishing provincial privacy legislation for the private sector. Currently, the private sector collection, use, and disclosure of personal information in Ontario is governed by the Personal Information Protection and Electronic Documents Act (PIPEDA), and the consultations are intended to address the gap in the province’s legislative privacy framework. The Government has outlined some of their goals for the new framework in “Ontario Private Sector Privacy Reform: Improving Private Sector Privacy for Ontarians in a Digital Age,” including transparency, application to not-for-profits, consent, right to be forgotten, data portability, enforcement, use of anonymized data, and data trusts.
