The Ministry of Public Security (the “MPS”) has prepared a Draft Decree on personal data protection (“Draft Decree”), which was shared on Feb. 9, 2021, for public comments. Key terms and the foundation of the Draft Decree include defining personal data as data about an individual or relating to the identification or possible identification of a particular individual, among other definitions; consent and exception; a requirement to notify the data owner prior to their processing, with exceptions; the four conditions that must be satisfied by cross-border transfer of personal data of Vietnamese citizens; and penalties for violation of personal data protection rules.
