Minnesota Passes Law Requiring Monthly Checks of The State Exclusion List

A change to Minnesota law will make the Minnesota Health Care Programs Manual, which includes guidance on the Minnesota Department of Human Services’ (DHS) Medical Assistance exclusion list, binding in law. The new law, which will be effective Aug. 1, 2019, requires vendors to check DHS’s exclusion list “on a monthly basis and document the date and time the exclusion list was checked and the name and title of the person who checked the exclusion list.” If a vendor discovers that an employee or contractor appears on the list, the vendor is to “immediately terminate payments” to that individual or entity, as well as refund any payment related to either items or services rendered by an individual or entity on the exclusion list dating back to the later of the individual’s or entity’s first appearance on the list or the first payment made to the individual or entity.
