On May 2, 2018, an amended law permits employers in the state of Maine to enforce workplace policies restricting the use of marijuana and to take disciplinary action in accordance with those workplace policies. The original law prohibited employers from refusing to employ a person who used marijuana outside of the employers property, while the new law does not require an employer to permit or accommodate the use, consumption, possession, trade, display, transportation, sale or cultivation of marijuana or marijuana products in the workplace. In addition, the new law states that an employer may enact and enforce workplace policies restricting the use of marijuana and marijuana products, and allows the employer to discipline employees who are under the influence of marijuana in the workplace or while otherwise engaged in activities within the course and scope of employment.
