Maine Enacts Pay Equality Law Banning Salary History Inquiries

Maine has become the eighth state to enact a salary history ban that prohibits employers from asking job applicants about their salary histories and broadens existing wage transparency requirements. Legislative Document (L.D.) 278 (An Act Regarding Pay Equality) specifically not only restricts employers from asking about compensation history until after a job offer has been extended, it also bars employers from making such inquiries directly to the candidate’s current or former employer. Exceptions do exist, however, allowing employers to confirm salary history if the candidate voluntarily discloses it and the law does not apply to an employer who “inquires about compensation history pursuant to any federal or state law that specifically requires the disclosure or verification of compensation history for employment purposes.”
