Iowa Employers Must Ensure Strict Adherence to State’s Drug Testing Law

The case of Scott Hampe v. Charles Gabus Motors Inc. d/b/a Toyota of Des Moines et ano, has demonstrated the risks to employers who do not strictly comply with all facets of Iowa’s drug testing law. Hampe was terminated for refusing a random drug test due to time constraints. He filed suit under the Iowa drug testing law, which provides a right of action to aggrieved individuals. Claims were initially dismissed but, on appeal, the court held that further proceedings would be allowed to resolve the issues of The Random Testing Pool, Supervisor Training requirements, and the Uniform Disciplinary Policy.
