A trial court’s order for summary judgment has been reversed by the Missouri Court of Appeals in favor of an employer for lack of standing in a case brought under the Fair Credit Reporting Act (FCRA). The employer in Courtright, et al. v. O’Reilly Automotive withheld an offer for employment based on inaccurate information obtained through a criminal background check. Three applicants filed suit asserting, among others, adverse-action claims against O’Reilly after their conditional offers were revoked. The clients alleged that the business failed to disclose the contents of each applicants’ background reports and provide them the opportunity to cure any inaccuracies before taking adverse action against them.
