Businesses across the country are struggling to understand changing marijuana laws and what can be included in drug screening policies within the workplace. Although guidance can be murky, “each workplace environment is entitled to have and enforce its own policies, especially when it comes to private employers,” according to Michael O’Brien, CEO and general counsel at Sonoran Roots Craft Cannabis. It is important, however, to remain mindful of state laws that have legalized marijuana for both medicinal and recreational use. Some employers consider treating marijuana like alcohol, using evidence of impairment as a guide, but they must be slow to jump to conclusions.
