Although modern technology can help organizations improve their capabilities to make the right hire, it is important to be aware that some of these systems can develop learned biases, especially when it comes to race and gender. The Federal Trade Commission (FTC) issued guidance in 2020 that discusses the use of AI for Machine Learning technology and automated decision-making with regard to federal laws that included the Fair Credit Report Act (FCRA). “Using Artificial Intelligence and Algorithms” indicates that employers should consider three primary areas: 1. Transparency around how the AI is used, 2. Transparency around data collection and 3. Disclosure of algorithm decision-making.
