Court Win for Employer Sheds Light on Background Check Laws

An employer scored a recent win under the Fair Credit Reporting Act (FCRA) in Schumacher v. SC Data Center, Inc. The court found that while the employer had violated the FCRA when it failed to provide the plaintiff with a copy of the background check prior to rescinding a job offer, the plaintiff could not prevail under the FCRA because applicants do not have the right to explain the context behind accurate but negative information found on reports.
