Could Recreational Marijuana Use Jeopardize a Nevada Employee’s Job?

Recreational marijuana is legal in Nevada, but a Nevada Supreme Court recently analyzed whether an employer could discharge an employee for recreational marijuana use. In Ceballos v. NP Palace, LLC, an employee tripped and fell in the employee breakroom and submitted to a drug test, which showed positive results for marijuana. The employee was terminated, and the Court held that “although Nevada has decriminalized adult recreational marijuana use, the drug continues to be illegal under federal law …”
