A federal district court has refused to dismiss an Americans with Disabilities Act suit on summary judgment. In Huber v. Blue Cross & Blue Shield of Florida, Inc., an employee used physician-suggested CBD oil for years to treat migraines. The employer relied on a positive drug test result, rather than a letter submitted by the physician, and the employee’s position and that of a co-worker were terminated.
