Can Background Checks be Conducted on Current Employees?

Although most employers stop with a background check during the hiring process, there are several instances in which an employer may choose or have a need to rescreen an employee, such as when a current employee has been arrested, if security has been threatened, if there is the potential for harm to the business or for insurance reasons. It is important, however, for employers to remain compliant with federal laws, as enforced by the Equal Employment Opportunity Commission (EEOC), including obtaining consent from either the prospective or current employee. Employers would be wise to set a policy where every employee will be subjected to a new background screening annually.
