Brazilian Minister Says Decree to Create Data Protection Authority is Ready for Publication

Secretary-General of the Presidency of the Republic Jorge Antônio de Oliveira Francisco has announced that the Autoridade Nacional de Proteção de Dados (ANPD) is ready and may be published at any time. Brazilian Congress is due to vote on the Provisional Measure 959/2020 by Aug. 27, 2020, which temporarily delays the applicability of the new Brazilian data protection law to May 2021. In addition, a recent paper co-authored by CIPL and CEDIS-IDP provides a model for the establishment of the ANPD that goes beyond the data protection law by laying out practical aspects for establishing the ANPD.
