The new Arkansas law that allows for the use of medical marijuana requires use of a “Registry Identification Card,” providing patients who have qualifying medical conditions protections in the workplace. It is important for employers to understand the rules and regulations associated with an employee who has a medical prescription for marijuana use. For one, employers cannot discriminate against an employee based upon his or her past or present status as a qualifying patient. Employees cannot be disciplined for the medical use of marijuana if he or she possesses not more than 2 1/2 ounces or for giving a permitted amount or paraphernalia to another qualifying patient.
