New Jersey Bill Could Strengthen Employment Protections for Medical Marijuana Patients

A New Jersey bill, Senate Bill S3452, would strengthen employment protections for registered medical marijuana patients by making it unlawful for employers to take adverse action based solely on a positive cannabis drug test or a worker’s status as a medical marijuana cardholder. Employers could only discipline if they prove by a preponderance of evidence that lawful medical cannabis use impaired job performance, and the impairment must show specific symptoms at work.
