Getting behind the wheel when disqualified is a top driver file violation because a motor carrier is held liable whether or not a driver notifies them of a conviction or violation. Drivers are considered disqualified if their offense was committed during an on-duty time and they were employed by a motor carrier engaged in commercial interstate, intrastate, or foreign commerce. Using a physically unqualified driver is another top violation, as is not keeping inquiries into driving records in a Driver Qualification File. In addition, all carriers must maintain and update a Driver Qualification File for each driver that contains the required information. Not keeping a medical certificate in a driver’s file is another common violation.
