Personal Data Protection Bill, 2019

The Personal Data Protection Bill, 2019 (“Bill”) is being examined by the Joint Parliamentary Committee and will be presented before the Parliament in the coming budget session of 2021. The bill, which seeks to revamp India’s current data protection scheme, proposes to regulate the processing of personal data of individuals that is processed by the government, companies registered in India, and foreign companies. Key provisions under the bill include the definition of personal data, data fiduciary, data processing without consent, rights of the data principal, social media intermediaries, data protection authority, transfer of personal data outside of India, regulatory sandbox, offenses and penalties.
