The Consumer Financial Protection Bureau (CFPB) has issued a policy statement to explain the link between the Fair Credit Reporting Act (FCRA) and employers’ growing use of artificial intelligence to evaluate, rank, and score applicants and employees. The “Circular” reinforces the steps employers should take to assess the current technological tools they are using to determine whether they may constitute consumer reports, which would lead to the need to comply with the FCRA.
