If the employee’s state ID or driver’s license expired on or after March 1, 2020, and the document expiration date has been extended by their state due to COVID-19, it is acceptable as a List B document for Form I-9. But for workers who reside in states where the DMVs have not extended the validity of State Drivers’ Licenses and Identification Documents, and the employee is unable to present any other unexpired List A or List B document with a photograph, he or she is unable to work.
