CA DFEH Cracks Down on Fair Chance Act Violations

The Department of Fair Employment and Housing (DFEH) has announced an initiative that will use technology to conduct mass searches of online job ads for statements that violate the Fair Chance Act. Employers will receive a notice that requires them to remove the unlawful practice from its procedures and messaging. According to the statute, employers with five or more employees in the state of California may not ask applicants, prior to a conditional offer of employment, any questions that would disclose a conviction history and employers are required to comply with specific procedures for considering an applicant’s criminal history after a conditional job offer. The agency has provided a toolkit of resources to assist employers.
