In Kazakhstan, employers are entitled to obtain the relevant information directly from employees, but cannot obtain an applicant’s criminal or credit record directly from publicly available sources. Security checks may be conducted if the position is security-sensitive (i.e., national security officers). Hiring a third party to conduct background checks is not regulated and does not appear to be prohibited, provided the third party conducts its activities in accordance with the law.
