Although it can be helpful and 70 percent of employers admit to doing it, according to a 2020 survey by the Harris Poll, social media screening as part of the hiring process can be a risk for employers. Using information found on the Internet or on social media could lead to violations of the Americans with Disabilities Act, the Genetic Information Nondiscrimination Act, and the Equal Employment Opportunity law, among others. Those who choose to move forward with social media screening and other internet searches should provide a clear disclaimer to applicants and only conduct the search after a conditional job offer has been made.
