E-Verify for Federal Contractors

E-Verify is a mandatory program for employers with federal contracts that contain the Federal Acquisition Regulation (FAR) E-Verify clause. The free web-based service provides electronic verification of employment authorization. After entering information from the applicant’s I-9, E-Verify will provide one of the following results: 1. Employment Authorized, 2. Tentative Nonconfirmation (TNC) or 3. DHS Verification in Process. If a federal contract meets specific criteria, it qualifies for the FAR E-Verify clause and must use E-Verify. Should the prime contract contain the FAR E-Verify clause, its requirements apply to all tiers of subcontractors. In order to ensure compliance, employers must enroll the company or update the company profile in E-Verify if they were awarded a new contract on or after Sept. 8, 2009.
