Refusal to Hire Due to a Criminal Record: Who Bears Liability?

In Québec, employers cannot refuse to hire someone solely because of a criminal record unless the offense is directly related to the job’s duties under section 18.2 of the Québec Charter of Human Rights and Freedoms. A recent Court of Québec decision clarified that liability for discriminatory hiring falls on the employer, not recruitment agencies.
