Pot Company Trulieve Seeks Quick Win In Background Check Row

Florida’s medical cannabis company Trulieve moved for summary judgment in a proposed class-action lawsuit alleging the company misused consumer reports while doing background checks on prospective employees. Trulieve Inc. said Personal Security Concepts LLC, the firm that produced the background report at the crux of the plaintiff complaint is not a credit reporting agency under the FCRA and so claims brought under the law must be dismissed.

Trulieve said Personal Security Concepts had simply obtained public records from Florida’s Department of Law Enforcement and Department of Highway Safety and Motor Vehicles, and transmitted them to Trulieve, without analyzing or augmenting them. “The FCRA does not regulate information such as the public records at issue here merely because they were used in making an employment decision,” Trulieve said in its motion.
